ACE will experience an extended outage this weekend to perform software upgrades.

The outage will begin at 2100 EDT on Saturday, July 17, 2010 until 0700 EDT on Sunday, July 18, 2010.

FDA’s OASIS import system will be down for maintenance on Saturday, July 17, 2010, starting at approximately 01:00 am ET (0100) and is not anticipated to be back up until 10:00 pm ET (2200). As a result, FDA will be operating under the Prior Notice Contingency – Scenario 2.

During this downtime ACS, PNSI and the link between ACS and OASIS are operational. However, the OASIS downtime will prevent submitters who filed via ABI from receiving Prior Notice confirmation and would prevent CBP from auto-checking the Prior Notice Confirmation for ABI filers. If Prior Notice has not already been submitted, ABI filers may decide to wait out the OASIS downtime if they determine that the timeliness of Prior Notice will not be adversely affected. Filers who choose this option should understand that they remain responsible under Section 801(m) of the Act and under the Prior Notice Final Rule for filing timely prior notice. ABI transmissions received by FDA during the downtime will be queued and processed once the maintenance is completed. Prior Notice (PN) confirmation numbers will not be transmitted back to filers during the downtime.

Alternatively, filers may submit prior notice via PNSI, in which case the Prior Notice confirmation number must accompany the article of food (21 CFR 1.279(g)). If Prior Notice is submitted through PNSI, FDA and CBP recommend that the PNSI confirmation page, including the Prior Notice confirmation number and time stamp, be presented to CBP officers for cargo release. If the PNSI confirmation page is not presented, this may delay cargo release while the CBP officer, without being able to access OASIS, contacts FDA for verification of the prior notice confirmation numbers(s) and time of submission.

If Prior Notice has already been submitted via ABI/ACS prior to the interface outage, and confirmation has already been received, the submitter may proceed with Prior Notice using the standard process. If Prior Notice has already been submitted via ABI and confirmation has not been received prior to the interface outage, FDA and CBP recommend that, rather than resubmitting via PNSI, submitters should provide to CBP officers, at the time of cargo release, an endorsed (signed) copy of the ABI transmission or some other evidence adequate to show that Prior Notice has been submitted via ABI/ACS. Due to the length of this downtime, it may take some extra time for FDA field staff to perform FDA entry review and make admissibility “801(a)” decisions once OASIS becomes available. It is also possible that FDA field staff may need to rescind system “May Proceeds” issued right after the downtime is over. Notification of these “May Proceed” rescinds will be provided to filers. Please follow the instructions above for transmission of Prior Notice for food products. Filers may want to submit other FDA-regulated commodities in advance of this downtime.

Transmitting through the port of Pharr, TX 2305

Hello to all,

This message is for all of those that need to transmit through the port of Pharr, TX (2305) due to the flooding in the port of Laredo, TX (2304) and need to send your shipments through that port (2305). In order for you to transmit through the port 2305 you need to speak with your ABI rep to  have the port added to your profile. Also please be aware that if you do not have a dispatcher in the port 2305 you need to ask your rep to activate the AII in your profile as well and contact RBSystems so we may activate it as well. For the AII they do require a test to be done before any crossing can be done. If you do have a dispatcher in the port 2305 AII is not required all you need to do is contact your rep to have the port added to your profile and contact the local port in Pharr, TX and verify if anything else is required before doing your crossings.

SUBJECT: SCHEDULED PNSI DOWNTIME ON JULY 11, 2010 

FDA’S PNSI SYSTEM WILL BE DOWN FOR MAINTENANCE STARTING AT 1:00 AM, JULY 11, 2010, AND IS NOT ANTICIPATED TO BE BACK UP UNTIL 10:00 AM, JULY 11, 2010. AS A RESULT, FDA WILL BE OPERATING UNDER PRIOR NOTICE CONTINGENCY SCENARIO 4 DURING THIS TIME. DURING THIS DOWNTIME, ACS, OASIS AND THE LINK BETWEEN ACS AND OASIS WILL BE OPERATIONAL. IN THIS SITUATION, PRIOR NOTICE MAY CONTINUE TO BE SUBMITTED THROUGH ABI/ACS. HOWEVER, PNSI WILL NOT BE AVAILABLE AS NOTED. 

IF PRIOR NOTICE HAS BEEN SUBMITTED VIA PNSI PRIOR TO THE SYSTEM OUTAGE AND A CONFIRMATION NUMBER HAS ALREADY BEEN RECEIVED, THE CONFIRMATION NUMBER MUST ACCOMPANY THE ARTICLE OF FOOD (21 CFR 1.279 (g)). IN ADDITION, FDA AND CBP RECOMMEND THAT THE SUBMITTER ALSO PROVIDE THE PNSI CONFIRMATION PAGE, INCLUDING THE PRIOR NOTICE CONFIRMATION NUMBER AND TIME STAMP, TO CBP OFFICERS FOR CARGO RELEASE. 

OTHERWISE, IF PRIOR NOTICE HAS NOT BEEN SUBMITTED PRIOR TO THE SYSTEM OUTAGE, FDA WILL PROVIDE A LINK TO A FORM ON THEIR WEBSITE THAT WILL ALLOW FOR PRIOR NOTICE TO BE SUBMITTED BY EITHER E-MAIL OR FAX (21 CFR 1.280(c)). FDA DOES NOT INTEND TO ACCEPT ANY PRIOR NOTICE SUBMITTED BY THESE METHODS OTHER THAN DURING THE PNSI DOWNTIME (21 CFR 1.280 (c)).

FILERS MAY DECIDE TO WAIT OUT THE PNSI DOWNTIME IF THEY DETERMINE THAT THE TIMELINESS OF PRIOR NOTICE WILL NOT BE ADVERSELY AFFECTED. FILERS WHO CHOOSE THIS OPTION SHOULD UNDERSTAND THAT THEY REMAIN RESPONSIBLE UNDER SECTION 801(m) OF THE ACT AND UNDER THE PRIOR NOTICE FINAL RULE FOR FILING TIMELY PRIOR NOTICE.
